Forge Digital provides custom web design, web development, and related digital services to local service businesses in the UK and internationally. The specific scope of work for any project will be agreed in writing before work commences.

We reserve the right to decline any project enquiry at our discretion.

2. Free Website Audits

We offer a complimentary website audit to prospective clients. This audit is provided in good faith as a demonstration of our expertise and does not constitute a contract for services. The free audit:

• Is provided at no cost and with no obligation on either party
• Represents our honest professional opinion based on the information provided
• Does not guarantee any specific outcome or result
• May be withheld or limited at our discretion

3. Project Agreements

All paid projects are governed by a separate written agreement or proposal that both parties must accept before work begins. That agreement will detail:

• The scope of work and deliverables
• Timeline and milestones
• Fees and payment schedule
• Revision rounds and approval process
• Ownership and intellectual property

These Terms & Conditions apply alongside any specific project agreement.

4. Payment Terms

Unless otherwise agreed in writing:

• A deposit (typically 50%) is required before work commences
• The remaining balance is due upon completion or handover of the project
• Invoices are payable within 7 days of issue
• Late payment may result in suspension of work or hosting services

All prices are quoted in GBP and exclude VAT unless stated otherwise.

5. Client Responsibilities

To ensure a smooth project delivery, clients agree to:

• Provide all required content, images, logos and information in a timely manner
• Review and approve work within the agreed timeframes
• Provide a single point of contact for feedback and approvals
• Ensure they have the rights to use any materials provided to us

Delays caused by the client may affect the project timeline and we accept no liability for such delays.

6. Intellectual Property

Upon receipt of full payment, the client owns the final website design and all original content created specifically for their project. We retain the right to:

• Display the completed project in our portfolio
• Reference the client's business as a client in our marketing materials
• Retain any reusable code libraries, frameworks or components used across multiple projects

Third-party assets (fonts, stock images, plugins, frameworks) remain subject to their respective licences.

7. Confidentiality

We treat all client information shared during the course of a project as confidential. We will not disclose business-sensitive information to any third party without your explicit consent, except where required by law.

8. Results and Guarantees

While we build every website with best practices for SEO and conversion in mind, we cannot and do not guarantee specific search engine rankings, lead volumes or business outcomes. Results depend on numerous factors outside our control, including market conditions, competition and Google's algorithm.

Testimonials and case studies on our website represent individual results and are not typical guarantees.

9. Limitation of Liability

To the fullest extent permitted by law, Forge Digital's total liability arising from any project or engagement shall not exceed the total fees paid by the client for that specific project.

We are not liable for any indirect, incidental, or consequential loss including loss of profits, revenue or business opportunity.

10. Website Use

By using this website, you agree not to:

• Use it for any unlawful purpose
• Attempt to gain unauthorised access to any part of the website or its infrastructure
• Transmit any harmful, offensive or misleading content via our contact forms

We reserve the right to restrict access to this website at any time without notice.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
